1. Acceptance of Terms
By accessing and using the Bookish mobile application ("the App"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these Terms of Use, please do not use the App.
2. Description of Service
Bookish is a book tracking application that provides features including but not limited to:
- Book tracking and library management
- Spaced repetition learning system
- Note-taking and quote collection
- Reading progress statistics and analytics
- Reading goal setting and tracking
3. User Accounts
3.1 Account Creation
To use certain features of the App, you must create an account. You agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Maintain the security of your password and account
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized use of your account
3.2 Account Termination
We reserve the right to suspend or terminate your account at any time for violations of these Terms of Use or for any other reason at our sole discretion.
4. User Content
4.1 Your Content
You retain all rights to the content you create in the App, including notes, quotes, and personal data. By using the App, you grant us a limited license to store, process, and display your content solely for the purpose of providing the service.
4.2 Prohibited Content
You agree not to upload, post, or transmit content that:
- Violates any law or regulation
- Infringes upon intellectual property rights
- Contains malware, viruses, or harmful code
- Is defamatory, obscene, or offensive
- Harasses or harms others
5. Acceptable Use
You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the App in any way that violates applicable laws or regulations
- Attempt to gain unauthorized access to the App or its systems
- Interfere with or disrupt the App's functionality
- Use automated systems or software to extract data from the App
- Reverse engineer, decompile, or disassemble the App
- Use the App for commercial purposes without authorization
6. Intellectual Property
The App and its original content, features, and functionality are owned by Bookish and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
7. Third-Party Content
The App may display information about books, including titles, authors, and cover images, which may be obtained from third-party sources. We do not claim ownership of this content and it remains the property of the respective copyright holders.
8. Disclaimers and Limitations of Liability
8.1 No Warranties
The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
8.2 Limitation of Liability
To the maximum extent permitted by law, Bookish shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
- Your use or inability to use the App
- Any unauthorized access to or use of our servers and/or any personal information stored therein
- Any interruption or cessation of transmission to or from the App
- Any bugs, viruses, or other harmful code that may be transmitted through the App
- Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content made available via the App
9. Indemnification
You agree to indemnify, defend, and hold harmless Bookish, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the App or your violation of these Terms.
10. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Bookish operates, without regard to its conflict of law provisions.
12. Dispute Resolution
Any disputes arising out of or relating to these Terms or the App shall be resolved through binding arbitration in accordance with the rules of the relevant arbitration association, except where prohibited by law.
13. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
